THIS IS AN AGREEMENT BETWEEN YOU AND OKBlitz.com
Griffin Communications, who provides OKBlitz.com, offers online services including high school and college sports news, high school and college sports video, high school and college scores, community forums, social tools and user generated content. Access to content on OKBlitz.com is subject to your acceptance and compliance with the following terms and conditions.
OKBlitz.com offers these services to you conditioned on your acceptance, without modification, of this agreement. Accessing and/or using OKBlitz.com constitutes your acceptance of this agreement. If you do not agree to the following terms and conditions, you should not access or use OKBlitz.com.
OKBlitz.com reserves the right to change these terms, conditions, and notices under which it offers at any time and without notice. Any modifications to the terms, conditions and notices are effective immediately upon posting of the modified terms. Your use of the OKBlitz.com Web site after the posting of changes to the terms, conditions and notices signifies your acceptance of any changes to the agreement.
OKBlitz.com and Griffin Communications reserves the right to terminate any individual’s use of the OKBlitz.com Web site and/or individual user’s account(s) or password(s) if the user violates the terms of this agreement or if the user engages in conduct that OKBlitz.com and Griffin Communications, in its sole discretion, considers unacceptable. Removal and/or termination can occur with no notice to the user.
If any terms contained in this agreement conflict with any terms contained within an OKBlitz.com Web page, the terms of this agreement shall control. Your continued use of the service constitutes your acceptance of, and agreement to, this agreement, including any changes made to such agreement.
CODE OF CONDUCT
You agree not to engage in any of the following conduct. Such conduct is unacceptable and may result in termination of your use of the OKBlitz.com Web site: (a) Restricting and/or inhibiting another OKBlitz.com user from using and enjoying the OKBlitz.com Web site and services; (b) Posting and/or transmitting any fraudulent, libelous, threatening, unlawful, defamatory, abusive, obscene or otherwise objectionable or harmful information of any kind; (c) Without prior written consent from OKBlitz.com, posting and/or transmitting any solicitation of goods and/or services (including without limitation the solicitation of users of the OKBlitz.com Web site to become users of other competitive online services), promotion or advertisement for commercial purposes; (d) Impersonating any person, OKBlitz.com employees or entity or posting personally identifying information of any other person; (e) Posting or transmitting materials in violation of another party's copyright or intellectual property rights; (f) Using the OKBlitz.com Web site for any commercial or unlawful purposes, including "spamming"; (g) Modifying, adapting, sublicensing, translating, selling, reverse engineering, decompiling or disassembling any portion of the OKBlitz.com Web site; or (h) Posting or transmitting any information or software that contains a virus, worm, time bomb, Trojan horse, or other harmful or disruptive component.
PROHIBITED ACTIVITIES
You will not use any OKBlitz.com Web page to transmit, either directly or indirectly, any unsolicited bulk e-mail or unsolicited commercial e-mail. You will not send automated queries of any sort to the service without express permission in advance from OKBlitz.com. Please note that "sending automated queries" includes, among other things (a) Using any software that sends queries to the service to determine how a web site or web page "ranks" on the service for various queries; (b) "Meta-searching" the service; and (c) Performing "offline" searches on the service.
COPYRIGHT INFORMATION
OKBlitz.com, Griffin Communications and its subsidiaries respects the intellectual property of others, and asks its users, advertisers, licensors and service providers to do the same. OKBlitz.com, Griffin Communications and its subsidiaries do not intend to relinquish our respective rights, or any other party's rights, to the materials appearing on the OKBlitz.com Web site. Unless otherwise noted, Griffin Communications and OKBlitz.com owns all materials, including images, illustrations, designs, icons, photographs, video clips, and written and other materials that are part of the Web site. The material on the Web site is provided for private, non-commercial use only. As a provider of the service (which provides news, video, scores, a community forum and user generated content), OKBlitz.com is not in a position to arbitrate copyright disputes between copyright owners, on the one hand, and advertisers, Web site operators or users of the service, on the other hand. The advertisers, Web site operators, and users are responsible for their own content. Thus, OKBlitz.com, Griffin Communications and its subsidiaries encourage copyright owners to resolve their disputes directly with the advertisers, web site operators, and/or users. However, if an advertiser, web site operator, or user of the service, as the case may be, repeatedly infringes the rights of a copyright owner(s), OKBlitz.com may, in appropriate circumstances and at its discretion, (a) Disable and/or terminate the right of such advertiser to display its advertisements on OKBlitz.com Web Pages; (b) Exclude such Web site from being included in OKBlitz.com’s indices and web results; or (c) Disable and/or terminate the right of such user to use the service, as the case may be. If you believe that your work has been copied in a way that constitutes copyright infringement, and you believe it is appropriate to notify OKBlitz.com thereof, please send a notice that complies with Title 17, United States Code, Section 512(c)(3) to [email protected].
TRADEMARK NOTICE
The OKBlitz.com logo is a trademark and service mark of Griffin Communications. All other trademarks, service marks and logos used in the OKBlitz.com Web site are the trademarks, service marks or logos of their respective owners. You may not use any trademark or service mark appearing on the OKBlitz.com Web site without prior written consent of the owner of the mark.
YOU HAVE LIMITED TIME TO BRING YOUR CLAIM
You and OKBlitz.com agree that any cause of action arising out of or related to OKBlitz.com must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
PRIVACY
Personal information that OKBlitz.com Web site users provide in connection with purchases, contests, polls, chat rooms, community pages, forums or other usages of the OKBlitz.com Web site or site-related services is collected by OKBlitz.com, Griffin Communications and its subsidiaries. Any such information will be treated as described in our Privacy Policy. Users are strongly discouraged from posting any personally identifying information about themselves on public areas of the OKBlitz.com Web site.
YOUR ACCOUNT
By creating a personal or team page on the OKBlitz.com website you agree to take full responsibility for maintaining the confidentiality of your account username, password and for all activity that occurs under your account. You understand and agree that you will be liable for any activity performed by any person(s) using your account under your user name and password. OKBlitz.com, Griffin Communications and its subsidiaries reserve the right to refuse to post comments, and/or images and video, or to remove any information or materials, in whole or in part, in the sole discretion of OKBlitz.com, Griffin Communications and its subsidiaries, that are unacceptable, offensive or in violation of this agreement, in the sole determination of OKBlitz.com, Griffin Communications and its subsidiaries.

CONTESTS, SWEEPSTAKES AND PROMOTIONS
You acknowledge that if and when OKBlitz.com sponsors contest(s), sweepstake(s) or promotion(s), or third parties sponsor a contest(s), sweepstake(s) or promotion(s) in conjunction with OKBlitz.com, either OKBlitz.com or the third party will post terms and conditions in the official rules and/or registration area for the contest(s), sweepstake(s) or promotion(s) that apply to the particular contest(s), sweepstake(s) or promotion(s). Those terms and conditions, to the extent they conflict with this agreement, will govern that particular contest(s), sweepstake(s) or promotion(s).
OKBlitz.com MAKES NO WARRANTY
Griffin Communications provides the OKBlitz.com web pages "as is," "with all faults" and "as available," and the entire risk as to satisfactory quality, performance, accuracy, and effort is with you. To the maximum extent permitted by applicable law, the OKBlitz.com parties make no representations, warranties or conditions, express or implied, including, but not limited to: (a) Warranties of title, non-infringement, merchantability or fitness for a particular purpose, other than those warranties which are incapable of exclusion, restriction or modification under the laws applicable to this agreement. You acknowledge that any warranty that is provided in connection with any of the products or services described herein is provided solely by the owner, advertiser or manufacturer of that product and/or service, and not by OKBlitz.com, Griffin Communications or its subsidiaries. (b) You assume total responsibility and risk for your use of the OKBlitz.com Web site and site-related services. (c) Neither OKBlitz.com, Griffin Communications and its subsidiaries, nor our employees, agents, sponsors, third-party content providers or licensors are responsible or liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages under any contract, negligence, strict liability or other theory arising out of or relating in any way to the Web site, site-related services and/or content or information contained within the web site. INDEMNIFICATION
You agree to indemnify, defend and hold OKBlitz.com, Griffin Communications and its subsidiaries and its sponsors harmless from and against any and all claims, damages, costs or other expenses that arise directly or indirectly out of or from (a) your breach of this agreement, including the provisions relating to content submitted by you, (b) your violation of the code of conduct, and/or (c) your activities in connection with the web site or site-related services.
By using the OKBlitz.com Web site you are indicating that you agree to be bound by the terms of this agreement. If you do not agree to the terms of this agreement please do not enter the OKBlitz.com Web site. If you are not yet 18 years of age, a parent or guardian may agree to be bound by the terms of this agreement on your behalf.
